A Calgary man who plowed a van into a New Year's Eve crowd, killing a 24-year-old woman and injuring two others, has been found guilty of manslaughter.
Samrat Dhuna, 19, was accused of driving the wrong way down a one-way street and smashing into a group of people, killing Raminder Dhadda.
The jury, which deliberated for 2½ days, returned Friday afternoon to find Dhuna guilty on eight of 12 charges, including aggravated assault, assault with a weapon, assault causing bodily harm and hit and run.
As the verdict was read, Dhuna put his face in his hands, while others in the gallery, including at least one victim, sobbed quietly.
Outside the courthouse, members of the victims' families expressed disappointment and even anger at the verdict.
However, Crown prosecutor Jonathan Hak called the lesser conviction a victory.
"There would be very, very, few cases in the entire country where homicide has been the final result of an assault with a motor vehicle. In this case the jury found him guilty of a homicide offence and that's extraordinarily rare, so this is still a significant move within the law."
Dhuna is to be sentenced on Oct. 18.
*2 versions of what happened*
During the month-long trial, the jury heard two different versions of what happened that night.
Dhuna testified he had gone to Sam's Bar and Grill in the Kensington neighbourhood on New Year's Eve and was beaten up. He said he left, went drinking with his friends, and returned to the bar later that night to pick up some friends.
When they arrived at the bar, Dhuna said he was attacked again — punched, kicked and hit with a wooden board. As he was walking away, he said, someone threatened to kill him.
Dhuna decided to leave, going back to a van he had borrowed earlier that night. As he was driving the wrong way down a one-way street, he said he saw a group of people running toward the van with wooden boards and what he believed was a gun.
At that point, Dhuna said, he just wanted to get out of there. He testified that he ducked, and couldn't see out the windshield, and put the gas pedal to the floor.
But Crown prosecutor Hak told the jury Tuesday that Dhuna's version of events was improbable.
Dhuna would have negotiated a narrow street at high speed without seeing, missing a double parked van, said Hak.
Hak accused Dhuna of lying, adding that while testifying, Dhuna replied to questions 103 times with answers of "I don't know," "I don't recall" or "I don't remember."
Dhuna was returned to custody Thursday for allegedly breaking the rules of his release. Police say he missed his 9 p.m. curfew Wednesday night.
Now, I guess, Sam-th'-Rat will be apt to say "duh" and "nah" to his heart's content...
